User Conduct Rules

The following User Conduct Rules ("Rules") are part of the Terms of Service and govern your use of the Danger Developer Web site (the "Site"). PLEASE READ THESE RULES CAREFULLY. BY REGISTERING OR USING THE SITE, YOU ACCEPT AND AGREE TO BE BOUND BY THE RULES. IF YOU DO NOT ACCEPT THESE RULES, YOU MAY NOT ACCESS OR USE THE SITE.

You agree not to do any of the following while using the Site:

• violate any applicable law or regulation;
• harm minors or solicit personal information from minors;
• upload, post, email or transmit any content that You do not have the right to post or transmit;
• upload, post, email or transmit any content that infringes a third party's trademark, patent, trade secret, copyright, publicity, privacy, or other proprietary right;
• upload, post, email or transmit any content that is unlawful, untrue (including incomplete, false or inaccurate biographical information), harassing, libelous, defamatory, abusive, tortious, threatening, obscene, sexually explicit, hateful, abusive, harmful or otherwise objectionable;
• delete, tamper with or revise any material posted by any other person or entity;
• access, tamper with or use non-public areas of the Site or Danger's computer systems, or the technical delivery systems of Danger's providers;
• attempt to access or search the Site or any related Web site with any engine, software, tool, agent, device or mechanism other than the software and/or search agents provided by Danger or other generally available third party web browser (such as Microsoft Internet Explorer or Netscape Navigator);
• send unsolicited or unauthorized communications or "spam", including without limitation, promotions or advertisements for products or services;
• collect or harvest personal information about users of the Site or use such information to send unsolicited or unauthorized communications or "spam."
• use the Site to send altered, deceptive or false source-identifying information;
• attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Site;
• interfere or attempt to interfere with the access of any user, host or network, including without limitation, sending a "virus" to or through the Site, overloading, "flooding," "spamming," "crashing," or "mail bombing" the Site; or
• impersonate or misrepresent Your affiliation with any person or entity.

Violations of any of the above, including intellectual property infringement and breaches in security, will be investigated by Danger and, where appropriate, Danger may either institute legal action, or cooperate with law enforcement authorities in bringing legal proceedings, against users who violate these Rules.
